Supreme Court ruling against Southern Response could cost millions

The Supreme Court has made a “hugely significant” decision on earthquake repairs that could cost the Government many millions of dollars.
The court has ruled that a class action by Canterbury policyholders against insurance company Southern Response can go ahead on an “opt-out” basis.
The Government-owned earthquake insurance settlement company had challenged an earlier Court of Appeal decision that homeowners would not have to “opt in” to be part of the lawsuit.
The lawsuit claims Southern Response did not disclose full repair and rebuild costs in settlement negotiations, so homeowners were not aware of entitlements they could have received.
